New Canaan Man Faces DUI, Evading Charges after Causing Serious Accident on 123 in July

Police on Dec. 23 arrested a 46-year-old Smith Ridge Road man by warrant and charged him with driving under the influence, evading responsibility and following too closely, all in connection with a serious car accident in July.

At about 11:29 p.m. on July 17, police were called to the scene of an accident on Route 123 about .3 miles north of Country Club Road, according to a police report.

There, police learned that that a 2013 BMW traveling northbound and operated by the 46-year-old man had rear-ended a 2011 Nissan with two 22-year-old New Canaan girls inside, one the driver.

The Nissan had flipped over more than once, its occupants told police at the scene, and ended up on the guardrail of the southbound lane. Both women had their seatbelts on and went to Norwalk Hospital with lacerations, and one suffered a severe concussion and neck pain, police said.

Police smelled alcohol on the breath of the man who caused the accident, the report said, and he told them he’d had about five margaritas at a bar in New Canaan couldn’t recall what caused the accident, the report said. Also taken to the hospital, the man declined to have physicians there take blood, the report said, so police have no toxicology report on him.

The Nissan was totaled and the BMW sustained front-end damage, the police report said.

At the scene, the BMW operator was found about 50 feet past the accident and hadn’t phoned 911, which led to the evading charge, police said. A passerby phoned police, the report said.

The man was released on $1,000 bond and scheduled to appear Jan. 5 in state Superior Court in Stamford.
